1. Introduction

Thank you for visiting https://gocallable.com (the Site) and using the services of Callable Pty Ltd (ACN 693 196 333) (Callable, we, us, our).

These Terms & Conditions (Terms) govern your access to and use of the Site, any mobile or desktop application, software, APIs and related services provided by Callable (together, the Services), together with our Privacy Policy, as updated from time to time.

By accessing or using the Site or Services, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, you must immediately stop using the Site and Services.

“You” means any individual or entity that accesses or uses the Site or Services.

2. Changes to Terms

We may revise these Terms at any time by updating this page. Any changes take effect from the date published. Your continued use of the Site or Services after changes are published constitutes acceptance of the revised Terms.

We may modify, suspend or discontinue any part of the Services at any time without notice.

3. Eligibility & Use

By using the Site or Services, you represent and warrant that:

  • a telecommunications carrier or carriage service provider;
  • a communications platform; or • a provider of legal, business, marketing or compliance advice.

Callable provides a third‑party notification and availability coordination tool that enables users to signal availability and facilitate contact at their discretion. Users remain responsible for contacting recipients directly and for how notifications are used.

No professional, fiduciary, legal, advisory or agency relationship is created by your use of the Services.

No government authority has reviewed or approved Callable, the Services or their suitability for any particular purpose.

5. Account Registration & Security

Some features require account creation.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity that occurs under your account; and
  • promptly notifying us of unauthorised access or security breaches.

We are not liable for any loss arising from unauthorised use of your account.

6. Service Information & User Data

You may provide information through the Services, including:

  • account information;
  • availability settings;
  • recipient contact details; and
  • notification preferences (Service Information).

You authorise Callable to collect, process, store and transmit Service Information solely for the purpose of providing the Services, including transmission to recipients and third‑party delivery providers acting at your direction.

You confirm that you have all necessary rights, consents and lawful bases to provide any Service Information and to request notifications.

7. Fair Use, Anti‑Spam & Compliance

You must not use the Services:

  • to send unsolicited, misleading or unlawful communications;
  • in breach of privacy, spam, consumer protection or data laws;
  • to harass, abuse, defraud or impersonate others; or
  • in a way that interferes with the integrity or performance of the Services.

You are solely responsible for obtaining all required consents and providing legally compliant opt‑out mechanisms where required.

We may suspend or terminate access where we reasonably believe the Services are being misused or used unlawfully.

8. User‑Generated Content

You retain ownership of any content or information you submit through the Services.

By submitting content, you grant Callable a non‑exclusive, worldwide, royalty‑free licence to use, host, transmit and display that content solely for the purpose of providing the Services.

You warrant that your content does not infringe third‑party rights or applicable laws.

9. Intellectual Property

All intellectual property rights in the Site, Services, software, branding, trademarks, logos and content are owned by or licensed to Callable.

You must not:

  • copy, modify, distribute or reverse‑engineer any part of the Services;
  • scrape, data‑mine or harvest user data;
  • bypass security or usage controls; or
  • use Callable branding without written consent.

Unauthorised use may result in legal action.

10. Third‑Party Services & Links

The Services may integrate with or link to third‑party services.

Callable does not control and is not responsible for third‑party platforms, pricing, availability, policies or content. Your use of third‑party services is at your own risk.

11. Pricing & Payments

Any pricing, subscription fees or third‑party charges are subject to change without notice.

Callable is not responsible for fees imposed by third‑party delivery providers, app stores or payment processors.

12. App Store Terms

If you access the Services via the Apple App Store or Google Play: • these Terms are between you and Callable, not Apple or Google; • Apple and Google have no responsibility for the Services; • you comply with applicable app store terms; and • Apple and Google are third‑party beneficiaries of this clause.

13. Disclaimers

The Site and Services are provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, Callable disclaims all warranties, express or implied, including merchantability, fitness for purpose, accuracy, availability and non‑infringement.

Callable does not guarantee:

  • delivery, timing or receipt of notifications;
  • availability or uptime;
  • accuracy of availability signals; or
  • suitability for any specific use.

Nothing in these Terms excludes statutory consumer guarantees under Australian law.

14. Limitation of Liability

To the maximum extent permitted by law, Callable will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or Services.

Where liability cannot be excluded, it is limited (at Callable’s option) to resupply of the Services or payment of the cost of resupply.

15. Indemnity

You agree to indemnify and hold harmless Callable from any claims, losses, damages or expenses arising from:

  • your breach of these Terms;
  • your misuse of the Services;
  • your violation of law; or
  • your infringement of third‑party rights.

16. Termination

We may suspend or terminate your access immediately if you breach these Terms or misuse the Services.

Upon termination, all licences granted to you cease.

17. Force Majeure

Callable is not liable for failure or delay caused by events beyond reasonable control, including outages, network failures, acts of God, government actions or third‑party service failures.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of Queensland, Australia.

You irrevocably submit to the exclusive jurisdiction of the courts of Queensland.

Any claim must be commenced within 12 months of arising.

19. Miscellaneous

These Terms constitute the entire agreement between you and Callable.

  • If any provision is unenforceable, it will be replaced with a valid provision closest in intent.
  • We may assign these Terms without notice.
  • You may not assign without our consent.
  • Notices may be sent to your registered email address.
