These Terms & Conditions (Terms) govern your access to and use of the Site, any mobile or desktop application, software, APIs and related services provided by Callable (together, the Services), together with our Privacy Policy, as updated from time to time.

By accessing or using the Site or Services, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, you must immediately stop using the Site and Services.

“You” means any individual or entity that accesses or uses the Site or Services.

We may revise these Terms at any time by updating this page. Any changes take effect from the date published. Your continued use of the Site or Services after changes are published constitutes acceptance of the revised Terms.

Callable provides a third‑party notification and availability coordination tool that enables users to signal availability and facilitate contact at their discretion. Users remain responsible for contacting recipients directly and for how notifications are used.

No professional, fiduciary, legal, advisory or agency relationship is created by your use of the Services.

No government authority has reviewed or approved Callable, the Services or their suitability for any particular purpose.

5. Account Registration & Security

Some features require account creation.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity that occurs under your account; and
  • promptly notifying us of unauthorised access or security breaches.

We are not liable for any loss arising from unauthorised use of your account.

Unauthorised use may result in legal action.

10. Third‑Party Services & Links

Callable does not control and is not responsible for third‑party platforms, pricing, availability, policies or content. Your use of third‑party services is at your own risk.

11. Pricing & Payments

Any pricing, subscription fees or third‑party charges are subject to change without notice.

Callable is not responsible for fees imposed by third‑party delivery providers, app stores or payment processors.

12. App Store Terms

If you access the Services via the Apple App Store or Google Play: • these Terms are between you and Callable, not Apple or Google; • Apple and Google have no responsibility for the Services; • you comply with applicable app store terms; and • Apple and Google are third‑party beneficiaries of this clause.

13. Disclaimers

The Site and Services are provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, Callable disclaims all warranties, express or implied, including merchantability, fitness for purpose, accuracy, availability and non‑infringement.

Callable does not guarantee:

  • delivery, timing or receipt of notifications;
  • availability or uptime;
  • accuracy of availability signals; or
  • suitability for any specific use.

Nothing in these Terms excludes statutory consumer guarantees under Australian law.

14. Limitation of Liability

To the maximum extent permitted by law, Callable will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or Services.

Where liability cannot be excluded, it is limited (at Callable’s option) to resupply of the Services or payment of the cost of resupply.

15. Indemnity

You agree to indemnify and hold harmless Callable from any claims, losses, damages or expenses arising from:

  • your violation of law; or
  • your infringement of third‑party rights.

16. Termination

Upon termination, all licences granted to you cease.

Callable is not liable for failure or delay caused by events beyond reasonable control, including outages, network failures, acts of God, government actions or third‑party service failures.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of Queensland, Australia.

You irrevocably submit to the exclusive jurisdiction of the courts of Queensland.

Any claim must be commenced within 12 months of arising.

19. Miscellaneous

These Terms constitute the entire agreement between you and Callable.

  • If any provision is unenforceable, it will be replaced with a valid provision closest in intent.
  • We may assign these Terms without notice.
  • You may not assign without our consent.
  • Notices may be sent to your registered email address.
